Ziggy's Inflatables, LLC - Liability & Equipment Waiver

Participant Agreement, Release, and Assumption of Risk

Ziggy’s Inflatables, LLC, including its owners, officers, affiliates, volunteers, participants, employees, and all other persons or entities acting on its behalf, require all participants to agree to the following terms:

1. Acknowledgment of Risks

I acknowledge that participating in Ziggy’s Inflatables, LLC activities and using rental equipment entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, my property, or third parties. I understand these risks cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, but are not limited to:

• Falling, slipping, crashing, or colliding while using inflatable equipment.

• Injuries such as sprains, broken bones, and concussions.

• Possible transportation-related accidents.

• Equipment malfunction despite proper precautions.

• Risks of interaction between participants of different sizes.

• Possible exposure to illnesses.

I understand that Ziggy’s Inflatables, LLC employees seek to enforce safety measures but may not be able to prevent all risks.

2. Assumption of Risk

I voluntarily accept all risks associated with participating in this activity and using Ziggy’s Inflatables, LLC equipment. My participation is entirely voluntary, and I elect to engage in these activities despite the risks.

3. Equipment Rental Agreement

I agree to the following conditions regarding rental equipment:

• The equipment has been received in good condition and will be returned in the same condition (ordinary wear accepted).

• Ziggy’s Inflatables, LLC retains the right to repossess equipment at any time.

• I accept full financial responsibility for any damage to rental equipment, including full replacement costs up to $5,000.

• I agree that all users and supervisors will abide by safety instructions.

• I understand that overnight rentals require the blower to be removed from the inflatable and locked in a secure location.

• I agree to indemnify Ziggy’s Inflatables, LLC against any claims arising from the use of rented equipment.

4. Release of Liability

I voluntarily release, forever discharge, and agree to hold harmless Ziggy’s Inflatables, LLC from any claims, demands, or causes of action related to my participation or equipment use, including those resulting from the negligence of Ziggy’s Inflatables, LLC.

5. Legal and Financial Responsibility

• I certify that I have adequate insurance or agree to bear the costs of any injury or damage.

• If legal action is required, I agree to file solely in the state of Texas, and Texas law shall govern any disputes.

• If Ziggy’s Inflatables, LLC incurs legal fees to enforce this agreement, I agree to reimburse all associated costs.

7. Host Responsibility for Guests

I acknowledge that as the renter, I am responsible for ensuring all participants are aware of the risks involved. I agree to supervise all participants and ensure that only individuals who understand and accept the risks use the equipment. I further acknowledge that it is my responsibility to inform all guests of the safety guidelines provided by Ziggy’s Inflatables, LLC and enforce compliance with these rules.

6. Firework Damage Acknowledgment and Liability

I acknowledge that fireworks, sparklers, or similar incendiary devices may pose a risk to inflatable equipment and user safety. I agree to ensure that no fireworks or open flames will be used within 50 feet of the rental equipment. I understand that I am financially responsible for any and all damage resulting from fireworks or related debris, including cleaning, repairs, or full replacement up to $5,000. I release and hold harmless Ziggy’s Inflatables, LLC from any injury or property damage arising from fireworks, whether used by myself, my guests, or third parties.

7. External Hazards and Third-Party Actions

I acknowledge and accept that Ziggy’s Inflatables, LLC is not responsible for any damage, injury, or loss caused by external factors beyond their control, including but not limited to:

• Fireworks, sparklers, bonfires, grills, or other incendiary devices.

• Acts of vandalism, theft, or property damage by third parties.

• Damage caused by pets, wildlife, or insects.

• Environmental hazards such as wind, lightning, extreme heat, flooding, or other acts of nature.

• Interference by event guests or attendees not following safety rules.

I agree to maintain a safe environment around the rental equipment and ensure all reasonable precautions are taken to avoid these risks. I accept full financial responsibility for any damage to equipment resulting from such hazards, up to the full replacement value stated in this agreement.

Ziggy’s Inflatables, LLC will not be held liable for damages, injuries, or losses arising from these or similar circumstances, regardless of whether they were foreseeable.

8. Agreement to Electronic Signature

I understand that by typing my name below, I am electronically signing this agreement, which carries the same legal force as a handwritten signature.
