Ziggy's Inflatables, LLC - Guest Liability & Equipment Waiver

Participant Agreement, Release, and Assumption of Risk

I, the undersigned participant (or parent/guardian if participant is under 18), acknowledge that I am voluntarily engaging in activities involving inflatable equipment provided by Ziggy’s Inflatables, LLC. I understand and agree to the following terms:

1. Acknowledgment of Risks

I acknowledge that participating in activities involving inflatable equipment entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, my property, or third parties. I understand these risks cannot be eliminated without jeopardizing the essential qualities of the activity.

Risks include, but are not limited to:

• Falling, slipping, crashing, or colliding while using inflatable equipment.

• Injuries such as sprains, broken bones, and concussions.

• Possible transportation-related accidents.

• Equipment malfunction despite proper precautions.

• Risks of interaction between participants of different sizes.

• Possible exposure to illnesses, including COVID-19.

I understand that Ziggy’s Inflatables, LLC staff and the event host seek to enforce safety measures but may not be able to prevent all risks.

2. Assumption of Risk

I voluntarily accept all risks associated with participating in this activity. My participation is entirely voluntary, and I elect to engage in these activities despite the risks.

3. Release of Liability

I voluntarily release, forever discharge, and agree to hold harmless Ziggy’s Inflatables, LLC, its owners, officers, affiliates, employees, and the event host from any claims, demands, or causes of action related to my participation, including those resulting from the negligence of Ziggy’s Inflatables, LLC, the event host, or other participants.

I understand that the event host is responsible for supervising participants and enforcing safety rules. By signing this waiver, I also release and hold harmless the event host from any liability for injuries or damages arising from my participation.

4. Participant Responsibility

I acknowledge that I am responsible for my own safety while using Ziggy’s Inflatables, LLC equipment. I agree to:

• Follow all posted safety rules and verbal instructions from the event host or Ziggy’s Inflatables, LLC representatives.

• Use the equipment responsibly and ensure I do not endanger myself or others.

• Immediately stop participation if I experience discomfort, pain, or dizziness.

5. Legal and Financial Responsibility

I certify that I have adequate insurance or agree to bear the costs of any injury or damage incurred while participating in this activity.

If legal action is required, I agree to file solely in the state of Texas, and Texas law shall govern any disputes.

If Ziggy’s Inflatables, LLC or the event host incurs legal fees to enforce this agreement, I agree to reimburse all associated costs.

6. Agreement to Electronic Signature

I understand that by typing my name below, I am electronically signing this agreement, which carries the same legal force as a handwritten signature.
