Ziggy's Inflatables, LLC Waiver
Participant Agreement, Release, and Assumption of Risk

This agreement is made by Ziggy's Inflatables, LLC, its owners, officers, affiliates, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf. By signing this document, I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate, agree as follows:

1. Acknowledgment of Risk
   I acknowledge that my participation in inflatable games and activities with Ziggy's Inflatables, LLC entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, but are not limited to: exposure to the usual risks of cuts, bruises, sprains, and falls; potential for broken bones, head injuries, or other serious harm; collision with other participants; improper landing from bouncing or flipping; and risks associated with traveling to and from event locations. I acknowledge that equipment malfunctions and human error may also contribute to the risks involved.

1. Assumption of Risk
   I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation is purely voluntary, and I elect to participate despite the risks.

2. Release of Liability
   I voluntarily release, forever discharge, and agree to indemnify and hold harmless Ziggy's Inflatables, LLC from any and all claims, demands, or causes of action connected with my participation in its activities or use of its equipment, including any claims based on negligence.

3. Indemnification
   Should Ziggy's Inflatables, LLC or anyone acting on its behalf be required to incur legal fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such expenses.

4. Insurance Responsibility
   I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

5. Legal Venue and Severability
   In the event of a dispute, I agree to file any lawsuit solely in the state of Texas, and that Texas law shall govern. If any portion of this agreement is found to be void or unenforceable, the remaining provisions shall remain in full force and effect.

6. COVID-19 Liability Waiver
   I acknowledge that participation in activities at Ziggy's Inflatables, LLC may expose me to the risk of contracting COVID-19. With full awareness of these risks, I release and discharge Ziggy's Inflatables, LLC, its officers, employees, agents, and affiliates from any liability, claims, or damages related to COVID-19 exposure.

7. Responsibility and Compliance
   I agree to comply with all safety rules, guidelines, and instructions provided by Ziggy's Inflatables, LLC. I acknowledge that failure to do so may result in injury to myself or others.

8. Photography and Marketing Release
   I grant Ziggy's Inflatables, LLC the right to photograph, videotape, and/or record me and/or my child/ward and to use these images for promotional purposes. I understand that I can opt out of promotional communications at any time.

9. Parental Consent (For Minors)
   If I am signing on behalf of a minor participant, I certify that I am their parent or legal guardian. I agree to indemnify and hold harmless Ziggy's Inflatables, LLC from any claims brought by or on behalf of the minor related to their participation in these activities.

By signing this document, I acknowledge that I have read, understood, and agree to its terms. I recognize that by signing, I may be waiving certain legal rights, including the right to sue.
